Home‑care workers win their case

A group of home‑care workers has won justice after years of threats, racist insults and physical aggression from a client who was under psychiatric care. The FIQ brought the case before the Administrative Labour Tribunal, arguing that its members had not been protected the way they should have been.

The Tribunal agreed with the union and found that the CIUSSS du Nord‑de‑l’Île‑de‑Montréal failed to meet its obligations under workplace health and safety rules. The workers were exposed to repeated violence, including thrown objects, degrading comments and physical assaults, to the point where staffing agencies refused to send personnel.

The administrative judge noted that the behaviour left lasting impacts on the workers’ dignity and psychological well‑being. She found that the employer could and should have done more to reduce risks, better inform teams and intervene sooner.

The CIUSSS now has six months to correct the situation, and the file has been sent back to the CNESST for close follow‑up to prevent similar situations for other home‑care workers.
